Despite claims by Keurig, a redesign of its plastic K-Cup products did not make them suitable for all curbside recycling.

The agency said Keurig, in its financial filings, had claimed its pods could be “effectively recycled” but didn’t note that two big recycling companies wouldn’t accept them.

The company claimed its pods could be recycled anywhere, even though the two biggest recycling companies in the U.S. said they wouldn’t take them, regulators said.

K-Cup single use beverage pods, according to the U.S. Securities and Exchange Commission. In annual reports for fiscal years 2019 and 2020, Keurig stated that its testing with recycling facilities “validate(d) that (K-Cup pods) can be effectively recycled.

Keurig Dr Pepper, based in Burlington, Massachusetts, said in an emailed statement that it was glad to resolve the matter.

The multinational soft drink company will pay a $1.5 million settlement, but it isn't admitting or denying the agency's claims.
